These Terms of Service ("Terms") govern your access to and use of the HullSense mobile application, hardware device, and related services (collectively, the "Service") provided by HullSense LLC ("HullSense," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
Each HullSense hardware device may only be registered to one user account at a time. Registering a device that belongs to another user is prohibited. If you purchase a pre-owned device, the previous owner must remove it from their account before you can register it.
You are solely responsible for the proper installation and use of the HullSense hardware device. HullSense is not responsible for damage to your vessel or equipment resulting from improper installation. We recommend consulting a qualified marine electrician for installation.
The HullSense device is a monitoring and alerting tool only. It is not a safety device and does not replace proper vessel maintenance, insurance, or the judgment of a qualified captain. Alert delivery depends on network connectivity and is not guaranteed. Do not rely solely on HullSense alerts for the safety of your vessel, crew, or property.
HullSense offers a free tier with basic monitoring features and a Pro subscription that includes additional features such as LTE cellular monitoring, extended data history, geofencing, SMS text alerts, automatic trip logging with GPS routes, and advanced monitoring capabilities. Pro also includes daily Boat Health reports — brief summaries generated each morning from your boat's sensor readings, weather data, and tide information. These summaries are produced with the assistance of a third-party automated summary service (Anthropic, PBC); see our Privacy Policy for details on what data is shared and how it is handled. Feature availability is subject to change with notice.
Pro subscriptions are billed on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize HullSense to charge your payment method on a recurring basis until you cancel. All fees are in US dollars and are non-refundable except as required by law or as stated in our refund policy.
You may cancel your subscription at any time through the app or by contacting us. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the period ends.
We reserve the right to change subscription prices. We will provide at least 30 days' notice of price changes. Continued use of the Service after a price change takes effect constitutes your acceptance of the new price.
Pro subscribers may optionally enable SMS text alerts for vessel monitoring events (such as battery low, high-water detection, and geofence exit). By providing your mobile phone number and enabling SMS alerts in the app, you expressly consent to receive automated text messages from HullSense, delivered via Twilio, Inc.
SMS text alerts are an optional feature. Disabling SMS alerts does not affect your Pro subscription or access to any other Pro features.
You agree not to use the Service to:
All rights in the HullSense Service, including the mobile application, firmware, hardware design, and content, are owned by or licensed to HullSense. These Terms do not grant you any rights to our software or content except the limited license to use the Service as described herein.
You retain ownership of any data generated by your use of the Service. You grant us a limited, non-exclusive license to use that data to provide and improve the Service.
The HullSense Service provides monitoring data for informational purposes only. It is not a substitute for physical vessel inspection, professional marine services, or the exercise of independent judgment by a qualified captain or marine professional. Do not make decisions affecting the safety of your vessel, crew, or property based solely on information provided by the Service.
You agree to indemnify, defend, and hold harmless HullSense LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any damage caused by improper installation or use of the HullSense hardware device.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and indemnification — will survive.
You may terminate your account at any time by deleting your account within the app or contacting us. Account deletion is permanent and your data will be removed in accordance with our Privacy Policy.
These Terms are governed by the laws of the United States and the State of New Jersey, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
We may update these Terms at any time. We will provide notice of material changes through the app or by email. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance. If you do not agree to the changes, you must stop using the Service.
HullSense offers optional SMS text alert notifications to users with an active Pro subscription.
By enabling SMS alerts in the HullSense app and tapping 'I Agree & Enable', you expressly consent to receive automated text messages from HullSense at the US mobile phone number you provided.
Messages are transactional alerts only, including:
No marketing messages will be sent via SMS.
Message frequency varies based on your device activity. Messages are sent only when alert conditions are triggered.
Message and data rates may apply. HullSense does not charge separately for SMS alerts — standard carrier rates apply.
You may opt out at any time by disabling the SMS Alerts toggle in HullSense app Settings, or by replying STOP to any HullSense text message. After opting out, you will receive one confirmation message and no further alerts will be sent.

SMS alerts are available to US mobile numbers only and require an active HullSense Pro subscription.
HullSense is not liable for delayed or undelivered messages. Delivery is subject to your mobile carrier's coverage and policies.
